Numerous books have been written on construction law, but very few focus entirely on engineering law in Scotland. Yet there are very separate and distinct features of Scots law, which affect all those who work in and with the engineering industry in Scotland.

Scottish Engineering Contracts has been specifically written to re-address this imbalance. It provides – in one concise, practical volume – a basic guide to the principles of Scots law as they relate to engineering contracts and day to day operations and practices. The book also reviews key features of commonly used standard forms of engineering contracts, such as the ICE Conditions of Contract 7th Edition and the CECA Form of Sub-Contract. Rather than providing a clause-by-clause analysis of such standard forms, the book focuses on those clauses most frequently encountered in everyday industry life.

The book avoids legalese and jargon and instead captures difficult legal concepts in a straightforward, user-friendly language. Footnotes are provided throughout the text as reference sources, while extensive appendices provide advice on a number of topics such as the execution of documents under Scots law, and “jargon busting” the terminology used in Scottish court and arbitration proceedings.

An additional and important feature of this new book is its detailed chapter on environmental law – one of the fastest growing and increasingly legislated areas of law in the United Kingdom. A rudimentary knowledge of environmental law is particularly important in the engineering sector where the interface between the environment and engineering works is often acute.

Scottish Engineering Contracts will provide professional engineers, surveyors and commercial management staff in construction and engineering companies, or client organisations – with a readable and accurate and practical guide to the law relating to engineering contracts in Scotland. It will also prove to be an invaluable aid for anyone who is involved in the preparation of, or has to provide comment or guidance on, engineering contract documentation.
